Terms of Use
The Mobile application, the Site (www.harigaji.com) and the information and services offered on these platforms to you are subject to the following Terms of Use. The Mobile application and the Site will be collectively referred to as the “Platforms”. By accessing or using our Platforms or services, you are bound by this Terms of Use. If at any time you do not agree with the Terms of Use, you must immediately cease your use of our Platforms.
1. Description of our services
a. Overview of our services
HariGaji provides users a platform to track their salary from time to time and access a portion of their earned wages (“earned wage access”) based on their completed workdays alongside additional features. All this is done in coordination and with agreement of your employers who will share with us your data (read more about this in our Privacy Policy) that is required for our services to be provided. Upon registration, we will use the data provided about you from you or your employer to provide you with a Username and Password. The Password can be changed after your first login into the Mobile Application.
b. Accessing earned wage
By agreeing to this Terms of Use, you are agreeing for your employer to deduct the sum amount of your withdrawals for that month from HariGaji prior to paying your salary for the month. All HariGaji withdrawals will be observed as a company advance and as such will constitute as a payment of a proportion of your salary ahead of time. As such, it is important to ensure your account is only handled by you or an individual you fully trust.
c. Security of your information
Your security and privacy is very important to us and we will do the best to our ability by applying appropriate safeguards to protect your information, prevent loss and unauthorized use. However, we expect you to take full responsibility to protect your personal and account information on your end that are within your control and custody, to your best ability. You are expected to use secure connections when using our platforms and we shall not be held liable for any loss or issues faced due to an insecure connection. You are also expected to take full responsibility over your login details and, thus, agree to regularly change your password to ensure security.
d. Using the Platforms
HariGaji assumes all actions made in your account is made or authorized by you. As such, you are expected to take full responsibility of these and protect your information. We will attempt to undo any unintended actions when contacted but cannot guarantee the issue will be resolved especially if it is beyond our control.
e. Fraudulent activity
HariGaji reserves the right to terminate, delay, or suspend your access to and use of our platforms if we believe there has been fraudulent or suspicious activity related to your HariGaji account.
2. Interaction with linked bank account
a. The fees
In order to access our services, there will be a subscription or transaction fee involved which shall be deducted at the beginning of every subscription period once you have registered. The subscription or transaction fee will either be deducted from your requested amount or charged separately on your account based on the details that you provide.
b. Cancellation and Refund policy
To change or cancel your subscription, contact HariGaji at support@harigaji.com.
Issue of refunds or credits are done at our sole discretion. We are also under no obligation to issue the same or similar refund in the future. If you subscribed with the help of a third-party, you may contact this person to understand your agreement with them.
When a subscription is cancelled, you will lose access to the system and all future charges associated with future months of your subscription will be cancelled. You may notify us, at any time, if you are looking to cancel your subscription, but a cancellation will only be effective at the end of your current billing period. As such, you will not receive a refund for the remaining days in your subscription period but instead you will be able to have full access to our Platforms and services until the end of your billing period.
If you want to change your subscription plan, contact us and we will make the relevant changes. The change will only be effective at the end of your current billing period. c. Account change
You must notify your employer or us immediately if your linked bank account information changes. The earned wage access service and subscription fee charge use the linked bank account information regularly. If you do not alert Harigaji of any account changes, your Harigaji account and your participation in our services could be adversely impacted. We are not liable for any of these adverse impacts and do not control the functioning of your bank account provider, thus, we will not be liable for any delays associated with the providers. 3. Financial education
The financial education provided is simply relevant knowledge for you to better understand the economic environment. They are for informational purposes only and is not intended to replace or substitute for any professional financial, legal or other advice. We and our partners make no representations or warranties and expressly disclaim any and all liability in connection with any information offered or provided on our Platforms.
4. Online and Electronic Disclosure and Consent
HariGaji conducts its service using electronic means and by agreeing to these terms, you acknowledge that the services are and will be provided through electronic means, such as electronic transactions and communication.
You confirm that your consent of these terms of use allows HariGaji to collect relevant data (such as Name, Employee ID, Employment Start Date, NRIC/Passport No., H/P No., Email, Payroll salary information, Payroll bank account details, Attendance data) from your employer that will be used by HariGaji to provide its services and process transactions (view the privacy policy to learn more about your data). You acknowledge that this consent is given immediately on your first login to the application.
You further acknowledge that you signify your consent to be bound by any and all agreements, terms and conditions, and contracts in your transactions with HariGaji by clicking on the “Agree and Accept” or similar button while you are logged in at the Platform using your Login Information. You agree that these agreements, terms and conditions, and contracts are binding upon you in the same manner as if you physically affixed your signature thereon.
5. Intellectual property rights
Harigaji owns the software used by the Platforms and the intellectual property rights to the Platforms’ contents. You are not entitled to copy, use, publish, promote, integrate, combine our software, content or brand without our express written permission to do so. Any unlawful use or any of the aforementioned actions will constitute a material infringement of our intellectual property rights.
You shall not use any electronic communication feature in the website for any purpose that is unlawful, tortuous, abusive, and intrusive on another’s privacy, harassing, libellous, defamatory, embarrassing, obscene or threatening. HariGaji reserves the right to file the appropriate criminal and civil complaints and cause the prosecution of violators under the law.
6. Disclaimer
All materials and information provided in the Platforms are provided “as is” without warranty of any kind, either express or implied. Specifically, HariGaji does not make any warranties or representations about the accuracy or completeness of the material provided. In addition, this Terms of Use may be revised by Harigaji from time to time without prior notice. You will be alerted if any major changes occur. By continuing to use the Platforms, you are bound by the most current version of the Terms of Use.
7. Liability and Indemnity
HariGaji and its partners, affiliates, directors, officers and employees shall not be held liable for any loss, damage, liability or expense incurred or suffered which are claimed to result from the use of our Platforms, under no circumstances.
You also agree to hold all above mentioned parties free and harmless from any liability arising from any loss or damage in all instances mentioned in the previous sections of this Terms of Use and especially in the following instances:
1. The conduct of any user on our Platforms.
2. Delays on the use of our Platforms due to factors beyond our control.
3. Delayed or inaccurate information received due to failure or disruption of the communications used by HariGaji to provide your services.
4. Loss or damage caused by fraudulent activities resulting from the theft or unauthorised disclosure of your Login information.
